EVOLUCIÓN DOCTRINAL, LEGISLATIVA Y JURISPRUDENCIAL DE LOS DERECHOS DE LA PERSONALIDAD Y EL DAÑO MORAL EN ESPAÑA

Without reference to the mexican legislation, the author expounds on the evolution of the concept of moral damage and rights of representation in Spain. The article begins by expressing the Spanish vision of the concept of the rights of representation, as well as a general explanation of the possiiblity of suffering moral damage to these rights by a physical person, after the verdict of December 6, 1912. Subsequently, the author expresses the moral damage suffered by a legal entity, and finally, on the existence of sources of moral damage such as moral harassment or mobbing, and others deriving from the European Union Community Law.
