PARADOJAS DE LA AUTONOMÍA DE LA VOLUNTAD EN LAS RELACIONES DE TRABAJO

The "at will" relationship finds its limits in the public order. The key is that in labor matters this legal concept is paradoxical: workers are "at will" to accept a submissive, subordinate relation-ship with their employer, and to place themselves at his disposal, thus acquiring the obligation to obey. The objective of the agreement is for the salaried worker to renounce his own will, and to subject it to the will of his employer, thus leading to the company's perception that the worker is the subject and the objective of the con-tract. In such a legal structure, the worker is only at liberty to choose the employer to whom he must subordinate himself. The negotiating autonomy of the individual is currently going through a euphoric phase which, some years ago, was not foreseen by anyone.
