MARIAGE ENTRE PERSONNES DU MME SEXE ET LE DROIT L'ADOPTION *

The homosexual population, considered to be a "sexual minority", is subject to multiple forms of discrimination, both social and legal. In this regard, the right of homosexuals to contract marriage, as well as to grant them adoption rights, have been points of controversy in various countries of the world, whose position against this is held to be an act of discri-mination. The author, unconvinced by this holding, reflects on the legal nature of marriage and adoption. In the case of Me-xico, she points out that, in terms of doctri-ne and the law, the institution of marria- ge does not permit union between homose-xuals. Therefore, she suggests the creation of a legal identity similar to marriage for these unions. As regards adoption, she emphasizes "the superior interests of the child", as a Principle of International Law; under the hypothesis that this does not involve only the rights of the homose-xual couple, but rather that it involves a third party, whose rights must also be res-pected.
