Heart transplant cases present not only ethical, but legal and social issues, because a consideration of the criteria for the diagnosis of death based in the certification of encephalic death, with the inclusion of irreversible cardiac arrest, has presented serious problems for acceptance, especially from the cultural significance viewpoint with psychological repercussions, presented by the cardiac organ. With a multi-disciplinary bio-ethical focus, an analysis is made of the legal, philosophical and ethical presupposi-tions of in mortis transplants against the problem of disposing of a human body and the diagnosis of encephalic death.
