EL DERECHO DE RETENCIÓN EN EL NUEVO CÓDIGO CIVIL HOLANDÉS

The author begins his article emphasizing the importance of Comparative Law to the subject of asset and com-mercial law. He mentions the newest of the civil codes currently in existence: The Dutch Civil Code. Subsequently he concentrates his attention on the so-called "Law of Withholding", comparing the Mexican doctrinaire definition thereof, to that of the aforesaid Code, at the same time pointing out the limitation thereof in our legal system, with basis in our Constitution. He speaks of the importance of the Law of Withholding to current commercial practice, since the growth of markets coincides with the growth of companies, and therefore, it is difficult for these companies to know their clients. And if the objective is to seek security in commercial practices there will be a tendency to exchange personal trust for the safety of things. Taking into account the reasoning in favor of expansion of the said Law of Withholding, he invites the Jurists of other countries to consider the expansion of the said law in their own legal systems.
