LOS DERECHOS HUMANOS DEL INDOCUMENTADO. SU DESCONOCIMIENTO POR LA JURISPRUDENCIA ESTADOUNIDENSE

M. Guillermina MAGALLÓN GÓMEZ *

The author gives a brief summary of the constitutional rights given to all individuals within the boundaries of the United States of America by the Fourth and Fifth Amendments to the United States Constitution, as well as the rights which emanate from the Thirteen Amendment to the Constitution, commonly known as the civil rights protections, as codified in Section 1981, Title 42 of the United States Code. She explains how the judiciary has interpreted the Fourth and Fifth Amend-ments as they apply to undocumented illegal aliens and how the courts have nullified the constitutional and civil rights protections which might otherwise be afforded these individuals when invoked by any of the multitude of undocumented illegal aliens residing today in the United States of America.
