EL ALEJAMIENTO DEL DOMICILIO FAMILIAR DEL AGRESOR EN EL DERECHO ALEMÁN. LA VIOLENCIA DOMÉSTICA Y LOS ACTUALES INTENTOS LEGISLATIVOS PARA SU CONTENCIÓN *

The author points out that in Germany, "Welcome Houses" have been established as a refuge for women domes-tic violence victims. In turn, she criticizes the German criminal procedure for the attention to the said crime and comments on the legislature's reaction to establishing the recently granted right to the police to forcefully evict the aggressor from the family dwelling, pointing out as its ante-cedent, the current Bill for Protection Against Violence which is said to become effective on January first, 2002, as part of the program to contain domestic violence established by the German federal govern-ment. She points out the existence in the Bill, of a gray zone concerning the time elapsing between committing the violent act and the time of pronouncing the decision, suggesting that the woman should be granted the liberty to choose between entering a "Welcome House" or the aggre-ssor being forbidden to go near her.
