LA RESPONSABILIDAD CIVIL EN EL CÓDIGO NAPOLEÓN. LAS BASES DE SU ESTRUCTURA DOGMÁTICA

Andrés CRUZ MEJÍA *

The author explains how it is that the dogmatic construction of the French Civil Code of 1804 continues to live in many current civil legislations, by regulating civil liability as an effect of non-compliance with obligations. It encompasses the growth of damages and risk situations operating in highly tech- nicalized socities of the post-industrial era, and addresses the need to re-think new standardizing structures that will respond to society's need to confront the phenomenon of damage.
